This Image & Likeness Release Waiver ("Release") is entered into as of the date of the signature below (the "Effective Date") by the undersigned individual in favor of NDB Distribution, LLC d.b.a. “VIVAZEN”, its parents, subsidiaries, affiliates, successors, licensees, and assigns (collectively, the "Company").

By checking the box below or signing electronically I acknowledge and agree that:

• For good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I irrevocably grant to the Company an unrestricted, perpetual, worldwide, royalty‑free license to photograph, film, record, and otherwise capture my name, image, likeness, voice, appearance, and/or statements (collectively, the "Content") at, or in connection with, any Company‑sponsored event, brand activation campaign, including but not limited to, the MARTA PeachTree Subway Station (each, an “Activation Event”).
• The Company has my consent to photograph, film, or otherwise record me as part of producing the Content and any Activation Event.
• I further grant the Company the right to use, reproduce, edit, modify, adapt, publish, display, distribute, publicly perform, create derivative works from, and otherwise exploit the Content, in whole or in part, in any manner and in any media now known or later developed, including but not limited to paid advertising, any Activation Event, social media, websites, digital platforms, print materials, promotional campaigns, and other marketing or commercial purposes, without providing me further notice or obtaining my prior approval. 
• I waive any right to receive any compensation of any kind for any use of the Content by the Company.
• I release and hold harmless the Company from any claims related to the use of this Content, including privacy or publicity claims.
• I represent and warrant that I (i) am 21 years of age or older as of today; and (ii) have the full legal right and capacity to enter into this Release authorizing the foregoing use of the Content by the Company.
